| چکیده بر مبنای قاعده‌ی تقاص، زمانی‌که صاحب حق به حاکم رجوع می‌کند ولی توان اثبات یا اجرای حق خود را ندارد در این صورت هر فردی که از وجود دین مطلع باشد می‌تواند احقاق حق کند. این نهاد، که از لحاظ ماهیت، در قالب ایقاع عینی، قابل تعریف است؛ سبب ایجاد حق مالکیت موقت برای تقاص گیرنده نسبت به مأخوذ به تقاص می‌شود. Taghas Abstract Under the Islamic (Shiite) institution of Taghas, in case the creditor/owner could not prove his claim before the judge or enforce his rights through the court, in this case, any person who is aware of the credit can enforce the right. This institution which is definable under the framework of objective Unilateral Act, causes temporary ownership for the performer of Taghas in relation to the received right.
